These Terms of Service ("Terms") apply to your use of schlafkontrolle.com and to purchases from Schlafkontrolle. The store is operated by Dmytro Bukhtaiev trading as Schlafkontrolle, with a business and correspondence address at 5 Cheapside, London EC2V 6AA, United Kingdom. Please read these Terms together with our Privacy Policy, Shipping and Delivery Policy and Return and Refund Policy. Nothing in these Terms excludes or restricts any mandatory rights or remedies available to you under applicable consumer law.
1. Eligibility and account responsibility
You must be legally capable of entering a binding contract to place an order. If you create an account, you are responsible for keeping your login details confidential and for the activity reasonably attributable to your account. Tell us promptly if you believe it has been used without permission.
2. Store information
We try to keep descriptions, images, specifications, availability and prices accurate and understandable. Screen settings and lighting may affect how colours appear. Packaging or minor product details may change where this does not materially alter the product. If an error affects an order, we will contact you before relying on materially different information.
General educational content is provided for information, not as individual medical advice. A product cannot guarantee sleep, diagnose, treat, cure or prevent a condition unless an authorised, product-specific statement expressly says so. Read and follow the instructions, warnings, contraindications and care information supplied with the product. If you have a health condition, use medication, are pregnant, or are unsure whether a product is suitable, seek advice from an appropriately qualified professional. Do not use a product that appears damaged or unsafe.
3. Prices, taxes and delivery charges
Prices are shown in the selected currency and include or exclude taxes as indicated at checkout. Delivery charges and any taxes or duties collected by us are shown before you submit the order. Your bank or payment provider may charge currency-conversion or other fees that we do not control.
4. Placing an order and contract formation
Your order is an offer to buy the items in your basket. An automated acknowledgement confirms that we received the order; it does not necessarily mean that we accepted it. A contract is formed when we send an acceptance or dispatch confirmation, or otherwise begin fulfilment, depending on the checkout wording and applicable law.
We may decline or cancel an order before acceptance for a legitimate reason, including unavailability, an obvious pricing or description error, inability to authorise payment, delivery restrictions, suspected fraud or unlawful activity. We will explain the reason where reasonably possible and refund any amount already taken for an order we cancel. We will not cancel on a prohibited discriminatory ground.
5. Payment
You agree to provide current and accurate billing, payment and contact information. Payments are processed through the payment methods offered at checkout. We do not receive your complete payment-card number where it is handled directly by the payment provider. Ownership of goods passes as provided by applicable law; risk to a consumer normally passes on physical delivery as described in our Shipping and Delivery Policy.
6. Delivery, cancellation and returns
Available destinations, processing, delivery estimates and related responsibilities are set out in our Shipping and Delivery Policy. Rights to cancel an online order, return goods and obtain remedies are set out in our Return and Refund Policy. Those policies form part of these Terms. If a policy conflicts with mandatory law, the mandatory law applies.
7. Safe and lawful use
Use each product only for its intended purpose and in accordance with its product page and supplied instructions. You must not deliberately misuse, modify or combine a product in a way that creates an unreasonable safety risk. Keep products away from children or vulnerable users where the instructions require it. Product-specific instructions and warnings take priority over general website content.
8. Website use and prohibited conduct
You may use the website for lawful personal or business purchasing and information. You must not:
- break applicable law or infringe another person's rights;
- introduce malicious code, interfere with security or attempt unauthorised access;
- scrape, overload or automate access in a way that materially disrupts the service;
- submit false, misleading or fraudulent information; or
- use our content, branding or product listings to impersonate us or mislead others.
We may restrict access where reasonably necessary to protect the store, customers or third parties, investigate misuse or comply with law.
9. Intellectual property
The website's original text, layout, graphics, branding and other content are owned by or licensed to us and are protected by applicable intellectual-property laws. You may view and make reasonable personal use of the website. No other licence is granted except as required for ordinary use of the service. Product names, marks or materials belonging to third parties remain the property of their respective owners.
10. Reviews and other user submissions
If you submit a review, message, photograph or other content, you confirm that you have the right to provide it and that it is not unlawful, defamatory, deceptive, confidential to another person or infringing. You retain ownership of your content but grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it for operating, supporting and promoting the store, subject to applicable privacy law. We may moderate or remove content for a legitimate reason. We will not manipulate reviews in a misleading way.
11. Third-party services and links
The store is powered by Shopify and may use third-party payment, delivery, analytics and support services. External links are provided for convenience or attribution. A link does not mean that we control or endorse every statement on the external site. Third-party services may have their own terms and privacy notices.
12. Availability and changes to the website
We may maintain, update or change the website and may suspend a feature where reasonably necessary. We do not promise uninterrupted or error-free availability. Changes to these Terms apply prospectively from the date posted and do not retroactively remove rights under an order already accepted. Material changes will be notified where required by law.
13. Our responsibility
We are responsible for losses that are a foreseeable result of our breach of contract or failure to use reasonable care and skill. We are not responsible for a loss that was not foreseeable, was caused by information or action for which you are responsible, or could not reasonably have been avoided despite appropriate care, except where the law says otherwise.
We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of mandatory consumer rights, or liability that otherwise cannot lawfully be limited. If you are acting wholly or mainly in the course of business, additional lawful limitations may apply, but they do not affect consumers.
14. Events outside reasonable control
We are not responsible for delay or failure caused by an event outside our reasonable control, but we will take reasonable steps to reduce the effect, keep you informed where appropriate and perform our obligations as soon as reasonably possible. Your mandatory rights, including rights concerning significant delay, remain unaffected.
15. Complaints
Please send complaints to info@schlafkontrolle.com with relevant order details. We will review the issue and respond within a reasonable time. Nothing in this section prevents you from using a court, regulator, consumer-advice body or alternative dispute process available under applicable law.
16. Governing law and disputes
These Terms are governed by the law of England and Wales. If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of the country where you normally live, and you may bring proceedings in any court that has jurisdiction under applicable consumer law. If you are not a consumer, the courts of England and Wales have exclusive jurisdiction.
17. General terms
If a court finds part of these Terms unlawful or unenforceable, the remaining parts continue to apply. A delay in enforcing a right is not a waiver of it. You may not transfer your contract without our agreement, except where the law permits; we may transfer our rights and obligations only where this does not reduce your protections. No person other than you and us has a right to enforce these Terms, unless applicable law provides otherwise.
